Scapegoat found in the Brazil mid-air

Courts Sentence Controller in 2006 Brazil Midair
A Brazilian air traffic controller was given a 14-month suspended sentence this week in the 2006 midair collision of a Gol Linhas Aereas Boeing 737-800 and an Embraer Legacy 600 business jet on its delivery flight to ExcelAire Services of Long Island, New York. The collision sent the airliner plunging into the Amazon forest, killing all 154 aboard, while the business jet managed an emergency landing at a military airbase. A military court found Air Force sergeant Jomarcelo Fernandes dos Santos had failed to note the disappearance of the Legacy’s transponder signal, failed to direct the pilot to make a frequency change, did not heed the altitude level on the airway and turned the flight over to his relief without alerting him of the irregularities. Four other controllers were absolved, including the one who issued the improper clearance that placed the Legacy on a collision course with the Boeing. The Brazilian press has relentlessly focused on the American Legacy pilots as the cause of the accident, but this sentence is the first public acknowledgment that the controller had an obligation to note that the transponder had stopped transmitting. Dos Santos and another controller still face charges in federal court in Sinop, along with the two American pilots of the Legacy, Joseph Lepore and Jan Paladino.
I`m sure this will not be the last we hear from this accident.
