EU Rebukes Germany for Airline Oversight Before Germanwings Crash

Commission faults Germany’s air-safety agency for years over staffing shortfalls that could hamper monitoring of air-crew medical status

Years before last week’s crash of Germanwings Flight 9525 by apparent co-pilot suicide, European Union officials worried that Germany’s oversight of airlines was lax and last November formally told Berlin to remedy the long-standing problems.
EU officials said Germany’s air-safety regulator suffered from chronic staffing shortfalls that could undermine its ability to run checks of carriers and crew, including medical checks, according to two people familiar with the issue.
Last week Andreas Lubitz, Flight 9525’s 27-year-old co-pilot whose history of depression was flagged in his medical file, crashed the Airbus A320 jet into the French Alps killing himself and 149 others on board, French prosecutors allege.
Whether the deficiencies identified in Germany’s air-safety supervision were factors in the crash remains unclear. The French air accident office, the BEA, leading the Flight 9525 crash probe said this week it would look at potential systemic weaknesses, including any on psychological screening of crew.

German Transport Minister Alexander Dobrindt said Thursday he would establish a task force to examine similar issues raised by the Germanwings crash. The task force isn't linked to the EU findings, though could end up touching on some of the same issues.
Germany has sent responses to the EU’s confidential rebuke in November of its federal aviation office, the Luftfahrtbundesamt, or LBA. Commission officials are now reviewing Germany’s “corrective action plan to address the findings,” a commission spokesman said.
Such citations aren’t unusual. The EU spokesman said every country in the 28-nation bloc has been cited for some aviation violations, without naming specific areas of concern. But the EU’s yearslong focus on aviation practices in Germany, one of Europe’s richest economies, is exceptional.
According to one of the people familiar with the EU findings, they relate to deficiencies in the LBA’s staffing levels and resources, access it provides to medical records and data, and its oversight of approved medical centers and examiners. More than 10 of the findings were related to medical issues, this person said.

      

The LBA declined to comment on the commission’s findings. The German transport ministry defended the LBA, which it oversees. “There is no cause for criticism of the LBA,” spokeswoman Vera Moosmayer said.
The LBA generally remains in the background of pilot screening and only gets directly involved if a pilot has been grounded and seeks reinstatement. Even so, the agency may have had information on Mr. Lubitz’s condition, a German medical examiner said, because he took time off from his training in 2009 for psychological issues.
Mr. Lubitz informed Lufthansa’s flight school that he had taken the break because of an “episode of severe depression,” the airline said Tuesday.
EU criticism of Germany’s shortfall in air oversight dates back at least four years. In 2011, officials from the EU’s European Aviation Safety Agency warned that Germany, Italy, Greece and some other countries weren’t complying with EASA-mandated oversight requirements as mandated by the commission through EASA.
In a highly unusual move, the commission in 2011 placed Germany on its quarterly list of aviation safety alerts, known as the airline blacklist. Its citation warned that the LBA suffered from “an insufficient numbers of qualified personnel” that could undermine the LBA’s ability “to ensure continuing oversight.”

Germany pledged to review personnel resources and staff levels. It was removed from the blacklist in late 2011.
The LBA, Germany’s equivalent of the U.S. Federal Aviation Administration, subsequently added some staff. But EU inspections continued to find shortfalls, many of which remained unresolved for an extended period, according to one person familiar with the findings.
EASA has said it communicates its findings to national civil aviation authorities and invites them to produce a corrective action plan. Airlines aren't involved in the process or implicated in problems.
Mr. Lubitz joined Germanwings, a budget unit of Deutsche Lufthansa AG, in September 2013. Before he was hired, he would have undergone psychological screening in a process also involving officials from the government-owned German Aerospace Center. The screening exceeds German legal requirements but is standard for Lufthansa, according to the airline and the transport ministry.
Mr. Lubitz’s license, which noted he had a special medical condition, required the physician performing his annual flight-fitness screening to inquire about the illness with the pilot himself or with the LBA-approved medical center holding his medical file.
The LBA doesn't store or have routine access to pilot medical files unless a pilot, having been grounded, appeals for a return to flying status. That differs from procedures in the U.S., where the FAA holds electronic records at a central facility.

EU agency found 'issues' with German aviation authority



The EASA had voiced concerns over Germany's "non-conformity" on aircrew health monitoring before last week's plane crash, a spokesman said. The co-pilot suspected of crashing the plane had suffered from depression.

The European Aviation Safety Agency "had pointed out several cases of non-conformity," with air safety rules, especially relating to monitoring the crew's health, spokesman Dominique Fouda said Saturday.
"On the basis of the EASA recommendations the European Commission launched, in late 2014, a process calling for accountability from Germany," he added.
The EU Commission confirmed the regulator found "issues" in a regular review of air safety enforcement.
"Germany's replies are currently being assessed," a Commission spokesmen told Reuters in an emailed statement.
"All EU member states have findings and this is a normal and regular occurrence," the Commission spokesman said, without specifying EASA's findings in Germany. "It is part of a continuous system of oversight: findings are followed by corrective action, similar to an audit process."

Co-pilot diagnosed as suicidal
Health monitoring and vetting of the crew came under public focus after a Germanwings plane went down in French Alps on March 24, killing all 150 people on board.
Co-pilot Andreas Lubitz, suspected of crashing the plane on purpose, had been diagnosed as suicidal "several years ago," according to German prosecutors. In addition, Lubitz allegedly told officials at an airline training school he had gone through a period of severe depression in the past.
Although doctors recently did not find any indication that 27-year-old Lubitz intended to harm himself or others, he had received treatment from neurologists and psychiatrists. He was signed off sick from work a number of times, including on the day of the crash.
But Carsten Spohr, chief of Germanwings' parent company Lufthansa, has said the airline was utterly unaware of any health issues that could have compromised Lubitz's fitness to fly - despite revelations from Düsseldorf prosecutors that he had emailed his flight school in 2009 about his treatment.

A routine check
The Wall Street Journal wrote on Saturday that "EU officials said Germany's air-safety regulator suffered from chronic staffing shortfalls that could undermine its ability to run checks of carriers and crew, including medical checks."
However, spokeswoman for the German aviation authority LBA said the regulator answered a single-figure number of criticisms by EASA and that such checks of national aviation authorities take place several times a year.

Search for bodies ends
Officials in France have ended their search for bodies in the Alps where the plane crashed, Reuters news agency reported.
"The search for bodies is over, but the search for the victims' personal belongings is continuing," said a spokesman for the Alpes-de-Haute-Provence region.
"Lufthansa has also hired a specialist firm to remove the debris of the aircraft, under the authority of the French public prosecutor and an expert in charge of environmental supervision of the operations," he said.
Identification of victims will continue through DNA analysis.

Sri Lanka's new government has accused the national airline of a "culture of corruption"
The Sri Lankan government has launched a criminal investigation into the country's national airline over allegations of "shocking" corruption.
A statement from the prime minister's office said that an inquiry had unearthed "major security breaches" at Sri Lankan Airlines.
The statement alleges irregularities in a $2.3bn purchase of 10 aircraft made under the previous government.
The loss-making airline is 95% state-owned and 5% owned by staff.
It is the latest in a string of corruption allegations made against the administration of former Prime Minister Mahinda Rajapakse.

'Serious mishaps'

The statement, issued by the office of Prime Minister Maithripala Sirisena, accuses Mr Rajapakse of making management changes within the airline to allow the $2.3bn-dollar purchase of 10 new aircraft "despite the availability of more cost-effective alternatives".
The former chairman of the airline, Nishantha Wickramasinghe, is also singled out by the statement, accused of a "gross abuse of power".
Mr Wickramasinghe - who is Mr Rajapakse's brother-in-law - is accused of exposing the airline to "reputational damage" by his "penchant for young air hostesses", as well as falsifying documents to lease a luxury sports car.
The statement also accuses the airline of attempting to "hush-up two serious flying mishaps", although no details are given.
Mr Sirisena defeated Mr Rajapaksa in the polls in January 2015. Mr Rajapaksa had been in power since 2005.

Flygere uten fast jobb jobber mer enn tilrådelig og tør ikke rapportere om feil av frykt for ikke å få videre jobb, viser en omfattende rapport om ansettelsesforholdene i flybransjen. Den er laget for EU-kommisjonen av Universitetet i Gent i Belgia.
I rapporten oppgir 34 prosent av flyverne at deres ansettelsesforhold påvirker beslutningene de må ta, for eksempel knyttet til om de føler seg skikket til å fly den dagen. Det er særlig i lavprisselskapene mange flygere jobber for bemanningsbyråer eller tar tidsbegrensede oppdrag.

Hard konkurranse

I mars ble over hundre tusen flypassasjerer rammet da en elleve dager lang streik satte mange tusen Norwegian-fly på bakken. Sentralt sto pilotenes tilknytning til selskapet.
Forskerne bak EU-rapporten undersøkte ansettelsesforhold i elleve europeiske land, og fikk inn svar fra over 6000 ansatte i flyselskaper.
47,5 prosent av flygerne i lavprisselskapene oppga at de ikke var fast ansatt, mot 21 prosent i bransjen som helhet. Særlig lavprisselskaper har mange piloter som er time- eller stykkprisbetalte, på innleie, korte kontrakter eller jobber med oppdragsflyvning.

Skader åpen konkurranse

Fra et juridisk synspunkt er det ikke nødvendigvis noe galt i slike ansettelsesforhold, men det åpner for misbruk, og omfanget av bruken er bekymringsfull, konkluderer rapporten.
Den fastslår at disse kostnadseffektive ansettelsesteknikkene er et direkte resultat av dereguleringen og fremveksten av nye forretningsmodeller i et mer konkurransepreget marked. Dette påvirker både den åpne konkurransen og de ansattes rettigheter, ifølge rapporten.
Det understrekes at det ikke er påvist noen sammenheng mellom ansettelsesformer og ulykkestall i luftftartsbransjen.

Blant forskerne som har bidratt til rapporten er Anne Mette Ødegård ved Fafo. Hun peker på flere grunner til at løse tilknytninger kan true sikkerheten.

– Det kan skje fordi flygere jobber mer enn det som er tilrådelig, og at de ikke tør rapportere om hendelser på grunn av frykt for å ikke bli reengasjert, sier hun.
De løse tilknytningsformene er et resultat av den harde konkurransen som foregår i luftfarten.
– Det diskuteres blant annet krav om at piloter må være fast ansatte nettopp av slike grunner, sier Ødegård.

Flygerne frykter ifølge ham at den gode rapporteringskulturen for å melde fra om egne feil uten å frykte straff, skal undergraves av at flygere ikke føler jobbsikkerhet.

Han sier det virker sannsynlig at kontraktsflygere kan ha en høyere terskel for å melde fra om begåtte feil eller sykdom fordi det er stor konkurranse om jobbene.
– Flyvere som møter på jobb med for eksempel feber er jo noe som kan påvirke blant annet oppmerksomheten, sier han.

SpyLite Claims New Range Record

A SpyLite mini unmanned air vehicle with a launch weight of 9kg (19.8lb) has achieved a communication range of 65nm(120km), which its manufacturer claims is a new world record for this category of system.
BlueBird says that during a demonstration for an undisclosed customer, the SpyLite reached a range of 65nm and remained over a target for 40min, before flying back to its landing point.This required it to fit the UAV with its latest-generation communication system, including aminiature airborne data terminal linked to a small, backpacked, ground data terminal weighing around 12kg.
The Israeli company lists long-range communications as one of the major challenges – alongside light weight and low power consumption – unmanned air system manufacturers are currently facing.
“This accomplishment enables BlueBird’s mini and small tactical UAS to provide long-range mission radius typically provided by much larger UAS with much larger and cumbersome communication equipment,” says company chief executive Ronen Nadir.
Originally designed to provide ground forces with a covert means of collecting “over-the-hill”, real-time visual intelligence, the SpyLite offers 4h flight endurance and a standard communication range of 27nm, which can now be extended.
SpyLite UAVs were used intensively during Israel’s recent military operations, including its “Protective Edge” operation over the Gaza Strip last year. BlueBird says the system has so far performed more than 10,000 operational sorties for the Israeli armed forces and other international military customers, including homeland security missions.

The RNZAF has operated the Bell UH-1H Iroquois light transport helicopter since 1966. This video was shot during a media familiarisation flight in the Huey before the Royal New Zealand Air Force’s 75th Birthday celebration airshow at RNZAF Ohakea.
The Bell UH-1 Iroquois (unofficially Huey) is a military helicopter powered by a single turboshaft engine, with two-bladed main and tail rotors. The helicopter was developed by Bell Helicopter to meet the United States Army’s requirement for a medical evacuation and utility helicopter in 1952, and it first flew on 20 October 1956. Ordered into production in March 1960, the UH-1 was the first turbine-powered helicopter to enter production for the United States military, and more than 16,000 have been produced worldwide.
The first combat operation of the UH-1 was in the service of the U.S. Army during the Vietnam War. The original designation of HU-1 led to the helicopter’s nickname ofHuey. In September 1962, the designation was changed to UH-1, but “Huey” remained in common use. Approximately 7,000 UH-1 aircraft saw service in Vietnam.

Statoil har inngått en fireårs-kontrakt med selskapet CHC Helikopterservice om 24-timers beredskap for redningsoppdrag i Nordsjøen. Basen blir på Sola, og er den sjette oljenæringen har for slike oppdrag.

Etter avtale med hovedredningssentralen på Sola (HRS) vil helikopteret med fullt mannskap også bli stilt til disposisjon for den offentlige redningstjenesten ved behov for redningsoperasjoner i første rekke til havs.
Sola-helikopteret kommer i tillegg til tilsvarende beredskap på SAR-baser (search and rescue) fra Hammerfest i nord til Ekofisk i sør. Redningsmannskapene på Sola-basen skal betjene et ti-talls plattformer så langt nord som til Grane-feltet 185 kilometer vest av Haugesund.

Flagges hjem

- I dag blir beredskapen for dette området dekket fra britisk sektor. Men fordi det har skjedd endringer der som berører tilbudet, flagger vi nå tjenesten hjem og satser på Sola i stedet, opplyser flysikkerhetsrådgiver Erling Munthe-Dahl i Statoil til Aftenbladet.

Statoil er godt fornøyd med den nye ordningen som Munthe-Dahl tror vil bidra til å øke beredskapen og sikkerheten for oljearbeiderne i Nordsjøen.

Som en midlertidig løsning vil tjenesten bli utført av et eksisterende helikopter av typen Airbus H 225, men fra mai vil et splitter nytt helikopter av samme typen være på plass på Sola.
Den nye tjenesten ble operativ fra midnatt, natt til 1. april. Ifølge baseleder Unn Birkeland hos CHC Helikopterservic på Sola vil totalt 20-25 personer være engasjert i tjenesten.
- Om natta vil de bo på hotell i nærheten av flyplassen, og være klar til utrykning på en halv times varsel. Om dagen vil de bo i et nytt modulbygg på basen vår, og ha en responstid på 15 minutter, opplyser Birkeland.

Nye Sola-jobber

Det nye tilbudet vil også bety noen nye jobber på Sola, selv om flesteparten kommer fra andre posisjoner i selskapet eller fra Statoil.
Helikopteret vil bli bemannet av kaptein, styrmann, heisoperatør, redningsmann og en spesialutdannet sykepleier.
- Kontrakten er viktig også for virksomheten til CHC Helikopterservice, og er kommet i stand gjennom et tett og godt samarbeid både internt hos oss og med Statoil, sier Unn Birkeland.

The F-35 Joint Strike Fighter has been flown in air-to-air combat maneuvers against F-16s for the first time and, based on the results of these and earlier flight-envelope evaluations, test pilots say the aircraft can be cleared for greater agility as a growth option. 
Although the F-35 is designed primarily for attack rather than air combat, U.S. Air Force and Lockheed Martin test pilots say the availability of potential margin for additional maneuverability is a testament to the aircraft’s recently proven overall handling qualities and basic flying performance. “The door is open to provide a little more maneuverability,” says Lockheed Martin F-35 site lead test pilot David “Doc” Nelson.
The operational maneuvers were flown by Nelson in AF-2, the primary Flight Sciences loads and flutter evaluation aircraft, and one of nine F-35s used by the Edwards AFB-based 412th Test Wing for developmental testing (DT). The F-35 Integrated Test Force at Edwards has six F-35As, two F-35Bs and a single F-35C dedicated to DT work, as well as a further set of aircraft allotted to the Joint Operational Test Team. Work is underway as part of efforts to clear the final system development and demonstration (SDD) maneuvering envelopes on the way to initial operational capability (IOC). The U.S.Marine Corps F-35B IOC is targeted for later this year, the Air Force’s F-35A in 2016, and the U.S. Navy’s F-35C  in 2019.
“When we did the first dogfight in January, they said, ‘you have no limits,’” says Nelson. “It was loads monitoring, so they could tell if we ever broke something. It was a confidence builder for the rest of the fleet because there is no real difference structurally between AF-2 and the rest of the airplanes.” AF-2 was the first F-35 to be flown to 9g+ and -3g, and to roll at design-load factor. The aircraft, which was also the first Joint Strike Fighter to be intentionally flown in significant airframe buffet at all angles of attack, was calibrated for inflight loads measurements prior to ferrying to Edwards in 2010.
The operational maneuver tests were conducted to see “how it would look like against an F-16 in the airspace,” says Col. Rod “Trash” Cregier, F-35 program director. “It was an early look at any control laws that may need to be tweaked to enable it to fly better in future. You can definitely tweak it—that’s the option.”
“Pilots really like maneuverability, and the fact that the aircraft recovers so well from a departure allows us to say [to the designers of the flight control system laws], ‘you don’t have to clamp down so tight,’” says Nelson. Departure resistance was proven during high angle-of-attack (AOA) testing, which began in late 2012 with the aircraft pushing the nose to its production AOA limit of 50 deg. Subsequent AOA testing has pushed the aircraft beyond both the positive and negative maximum command limits, including intentionally putting the aircraft out of control in several configurations ranging from “clean” wings to tests with open weapons-bay doors. Testing eventually pushed the F-35 to a maximum of 110 deg. AOA.

An “aggressive and unique” approach has been taken to the high AOA, or “high alpha” testing, says Nelson. “Normally, test programs will inch up on max alpha, and on the F-22 it took us 3-4 months to get to max alpha. On this jet, we did it in four days. We put a spin chute on the back, which is normal for this sort of program, and then we put the airplane out of control and took our hands off the controls to see if it came back. We actually tweaked the flight control system with an onboard flight test aid to allow it to go out of control, because it wouldn’t by itself. Then we drove the center of gravity back and made it the worst-case configuration on the outside with weapons bay doors and put the aircraft in a spin.” The aircraft has been put into spins with yaw rates up to 60 deg./sec., equal to a complete turn every 6 sec. “That’s pretty good. But we paddled off the flight-test aid and it recovered instantly,” he says.
Pilots also tested the ability of the F-35 to recover from a deep-stall in which it was pushed beyond the maximum AoA command limit by activating a manual pitch limiter (MPL) override similar to the alpha limiter in the F-16. “It’s not something an operational pilot would do, but the angle of attack went back and, with the center of gravity way back aft, it would not pitch over, but it would pitch up. So it got stuck at 60 or 70 deg. alpha, and it was as happy as could be. There was no pitching moment to worry about, and as soon as I let go of the MPL, it would come out,” Nelson says.
Following consistent recoveries, the test team opted to remove the spin chute for the rest of the test program. “The airplane, with no spin chute, had demonstrated the ability to recover from the worst-case departure, so we felt very confident, and that has been proven over months of high alpha testing,” says Nelson. “It also satisfied those at the Joint Program Office who said spin chute on the back is not production-representative and produces aerodynamic qualities that are not right.” Although there are additional test points ahead where the spin chute is scheduled to be reattached for departure resistance with various weapons loads, the test team is considering running through the points without it.

Highlighted as a “program concern” in the Defense Department’s Director of Operational Test and Evaluation (DOT&E) 2014 report, initial flight tests showed that all three F-35 variants experienced some form of wing drop in high-speed turns associated with asymmetrical movements of shock waves. However, TRO “has evolved into a non-factor,” says Nelson, who likens the effect to a momentary “tug” on one shoulder harness. “You have to pull high-g to even find it.” The roll-off phenomena exhibits itself as “less than 10 deg./sec. for a fraction of a second. We have been looking for a task it affects and we can’t find one.”
